3/26/2021 0 Comments Zantac Lawsuit Zantac Lawsuit is an out of court settlement between Zantac and a plaintiff who had filed a personal injury lawsuit against Zantac due to the manufacturer's negligence in producing Zantac N-nitrosodimethylamine. Zantac failed to warn the plaintiff that taking the medicine could cause heartburn and nausea, which lead to a case of acute congestive heart failure. After the case went to trial, the jury found for the defendant, awarding him a judgment for medical expenses incurred as a result of his use of Zantac N-nitrostepped in combination with nonsteroidal anti-inflammatory medications, or NSAIDs. The plaintiffs appealed the verdict, and they were allowed by the court to present more scientific evidence regarding the potential hazards of taking Zantac in conjunction with NSAIDs. In June of 2021, the US Court of Appeals for the Fifth Circuit affirmed the jury's verdict and sent the case back to a jury. On appeal, the parties agreed to a settlement, and plaintiffs were awarded compensatory damages. First, it is important to note that plaintiffs argue that Zantac knew its product caused adverse side effects prior to introducing it to the public, yet it still sold the product. This is important because if the drugmakers had warned consumers about the risks of taking Zantac, perhaps significant numbers of people would have avoided it. It is also interesting to note that the company does not admit any wrongdoing, and thus has no basis for escaping liability. Plaintiffs contend that the failure to warn was a direct violation of their right to seek damages under the law. According to the complaint, a few months after filing the lawsuit, a representative from Zantac visited the personal home of one of the plaintiffs and discussed the pending lawsuit. The plaintiffs say that the representative's representation that they could only obtain access to the medical records of "a select number of individuals" was untrue. The representative further stated that there was nothing to worry about, as there were only a few safeguards in place to avoid data theft, and that their data would remain safe. The company failed to warn the public about the drug's risks, and therefore bears partial liability for all future patients who may develop the disease as a result of using Zantac. If the court found the company had actual knowledge of the risk of using mass-tort lawsuits as a marketing tool, the company could be held personally liable for monetary damages. One other aspect of this lawsuit deals with whether Zantac contributed to the increasing trend of OTC heartburn medications, which are known colloquially as "non-steroidal anti-diarrheals." OTC heartburn drugs are not approved by the FDA and do not contain the same stringent safety measures that Zantac drugs have in place. As a result, the non-steroidal anti-diarrheals are more likely to cause an outbreak of heartburn when used on a regular basis. Zantac knew that some of its Zantac Lawsuit patients frequently used OTC heartburn medications, yet did nothing to warn the public. As a result of this, it is up to the court to determine whether or not the company was negligent in its conduct of business. This Zantac Lawsuit also targets the manufacturer of Zantac XR, which is the maker of Zantac as well as several other products. The plaintiff's attorney demands that the company be held legally responsible for all of the deaths and illnesses associated with Zantac, as well as for the costs associated with treating those patients who developed stomach cancer as a result of taking Zantac.
